Environmental Regulatory Compliance
Peter counsels makers of all kinds on state and federal environmental regulations and compliance. Ton Law P.C. takes a multidisciplinary approach, routinely engaging regulators, compliance professionals, scientists, engineers, insurance professionals, and business and community leaders in order to synthesize and communicate a clear path forward for his clients.
Peter has managed legal risk for a diverse set of clients including those in the paint, tire, plating, printing, lumber, mining, winery, glass container, automotive, chemical, semiconductor, distribution, technology and biotechnology sectors, as well as landowners, developers, local governments and nonprofits.
Representative Experience
Helped clients stay ahead of evolving regulatory compliance programs such as Prop 65 notice labeling, Clean Air Act engine import regulations, NPDES discharge permits, and hazardous materials handling regulations.
Represented clients in permit proceedings, inspections and enforcement actions initiated by U.S. EPA, California Department of Toxic Substances Control, California Regional Water Quality Control Boards, local air districts and certified unified program agencies.
Assisted clients in developing environmental, health & safety policies and procedures tailored to their specific needs and risk management philosophies.
Litigation
Litigation is a last resort, but when it happens Ton Law P.C. has the experience to resolve it in your favor. Peter has successfully litigated complex matters in both state and federal courts.
Representative Experience
Prosecuted CERCLA claims against United States and corporate polluters for contamination at former defense sites.
Represented developer in Clean Water Act citizen suit over stormwater discharges.
Defended glass bottle manufacturing company against California Department of Toxic Substances Control enforcement suit concerning hazardous waste handling requirements.
Transactions
Peter routinely advises small and large clients in commercial transactions. While Peter has specific environmental expertise, he has also developed a general commercial practice.
Representative Experience
Represented buyers and sellers in sale and development of contaminated properties, overseeing due diligence, environmental disclosures, and representations and warranties.
Negotiated agreements with regulatory agencies and other stakeholders to define roles, baselines, and outcomes in order to manage risks inherent in remediating contaminated properties.
Drafted and negotiated numerous commercial leases (e.g., gas stations, auto repair shops, restaurants, office spaces, etc.). Successfully negotiated seamless tenant transitions without interruption in rents.
Justice and Equity Pledge
Peter is honored to pledge 25% of his practice in 2022 to pro bono service focused on issues of equity.
As an immigrant and a product of the public school system, Peter learned early on the value of community and the importance of giving back. A driving force which motivated Peter to found Ton Law P.C. was to create a vehicle to better serve the community.
Peter received several awards and discussed topics related to his pro bono work on public radio and digital media.
Representative Experience
Partnering with a non-profit on the siting of a co-digester facility near a disadvantaged unincorporated community in the Central Valley.
Partnering with a non-profit to curb landfill pollution emanating from leased Tribal Lands to a migrant farm worker community in the Central Valley.
Advocating damage claims on behalf of Louisiana and Mississippi fisher-folk communities impacted by the BP oil spill in the Gulf of Mexico.
Providing direct legal services in numerous community clinics in the San Francisco Bay Area and Silicon Valley.
